Couverture de l’ouvrage E-commerce law jurisdiction
This special issue of the Comparative Law Yearbook ofInternational Business deals with the very topical subject ofe-commerce. This is an area that has seen an explosion of interest inrecent years but, since the increase in the use of the Internet as avehicle for conducting business transactions has been so rapid, thelaw has again fallen behind, particularly in the areas of regulationand jurisdiction. The situation is changing, however, with the introduction of bothnational and international legislation dealing with issues andrelating to, inter alia, data protection, privacy, electronicsignatures, consumer protection, and morality. The authors in thisvolume provide commentaries on the most recent developments in variousjurisdictions, including the approach of the European Union to theproblems raised by e-commerce. They discuss the difficulties inrelation to jurisdiction arising from the global nature of theInternet and the possibilities for dispute resolution betweenmulti-national parties to an electronic transaction. The topic is obviously one that will require much attention in thecoming years and one which will need strict regulation if electroniccommerce is destined to become the trading medium of the future.
